Ministry of National Defence apologised for causing disturbance in the society over the alleged illegal search by the military police of a civilian residence but asked the Control Yuan to investigate whether the search was legal and promised sanction if the Control Yuan found any violation of the law, making the Ministry a bystander. This is bizzare because the Ministry of National Defence is the responsible ministry and they should launch their own administrative investigation swiftly to determine the legality and report to the public and the Executive Yuan. If the Ministry of National Defence has not handled it appropriately, it will be subject to a Control Yuan investigation anyway and should not try to displace responsibility. Whether the civilian in question (Mr Wei) had violated the law cannot justify the illegal search and arrest. Consent for search without a warrant should be carefully assessed and determined. Let’s not forget that a lot of confessions during the Martial Law era were obtained under threat and coercion.
